Pak Lawyer Moves SC Against illegal Acts of Nepal Police
http://www.nepalnews.com/archive/2008/mar/mar03/news09.php
Kathmandu, Nepal, 3 March 2008 (NepalNews.com) - A Pakistani lawyerhas moved the Supreme Court (SC) in Nepal against what he calledillegal arrest of two Pakistani citizens by the Nepal Police and theirsubsequent handing over to the Indian authorities about two yearsago.
The two Pakistani citizens, Asif Ali and Walid Sajjad, had arrived inKathmandu [Nepal] to explore business opportunities and were stayingin Jagat Hotel, near the tourist hub of Thamel in Kathmandu beforebeing picked up by the Nepal Investigation Department on the night of12th July 2006 "without any apparent reason" or warrant issuedagainstthem. They were then reportedly handed over to the Indian intelligenceagency at the Embassy of India in Kathmandu.
C.M. [Chaudhry Muhammad] Farooq had filed a case against the illegalarrest of the two at the Supreme Court of Nepal under the InterimConstitution of Nepal, 2007, on Feb. 21 [2008]. Following which the SCissued a show cause notice, ordering the authorities to produce thetwo Pakistani citizens in the court.
"At the time of their arrest neither were they involved in any casenor had they violated any honorable law of Nepal. They were legallystaying in Nepal on legal visa," Farooq said in a statement issuedafterwards.
Farooq said that in spite of all the efforts to release the twoinnocent Pakistani citizens, the only outcome was the access grantedby the Indian Government to the Pakistan High Commission in New Delhi[India] to have a meeting with Asif Ali."
It was through that meeting that we came to know Asif Ali was charged/implicated in a fake FIR [First Information Report of Police] number59/2006 New Delhi, with different fake cases registered under sections121, 121-A/ 122, /123/120-B, Indian Penal Code, 4/5 ExplosiveSubstance Act, 18,2-B/23 Unlawful Activities, and 14 Foreign Act," hesaid.
He said that because of shock, the father of Asif Ali had died. Hesaid that Asif Ali was somewhat lucky as he had been located andgranted Counsellor Access but his business partner, Walid Sajjad, hasbeen neither produced in any court of law nor his whereabouts areknown.
"He is probably in the custody of Indian Intelligence agencies," he said.
The two Pakistani businessmen dealt in readymade garments and used toregularly travel to Bangladesh and the Middle East. They were alsosaid to have been carrying a substantial amount of money for businesspurposes.
The families of the Pakistani businessmen came to know about thearrest of their dear ones through the media in July 2006, which statedthat two Pakistani nationals were arrested on suspicion of involvementin Mumbai train blasts.

Thought to share with you.
Too lazy to go for the sugar, you somehow manage with that sugarless cup.
On finishing the coffee you discover the undissolved sugar crystals settled at the bottom.
Thats how life is....
We do not make any effort to value what is around or within us...
So look around, may be the sweetness you are looking for is closer than you think......

Amazingly Beautiful and Thought provoking..
Once there was an Island, where all the feelings lived together.
One day there was a storm in the Sea and Island was about to drown. Every feeling was Scraed but love made a boat to escape.
Everyone borowed the boat . One feeling was left. love got down to see who it was....
It was Ego.
Love tried and tried but Ego didn't move.
Everyone asked lobe to leave him and come in the boat but love was meant to love, it remained with Ego.
All the other feelings left alive but Love died because of Ego.

Significance of Honesty in Islam
The great scholar and ethical thinker, al-Muhâsibî, once said:
"For honesty to be complete, it must exist in three things। It must exist in the heart as one's faith, it must exist in the intentions behind one's deeds, and it must be present in the words that one speaks."
Honesty penetrates to the innermost fiber of a person when his inner being is in harmony with his outer self। A person's deeds are honest only when he practices what he professes. Dishonesty in deed is more despicable than dishonesty in word, for it is naught but a hypocritical display of sincerity. This is what the brothers of Joseph (peace be upon him) did when they came with Joseph's bloody clothing to their father.
Allah says: "So they came with his shirt stained with false blood." [Sûrah Yûsuf: 18]
Allah warns us saying: "O you who believe, why do you say what you do not do? It is loathsome indeed with Allah that you say what you do not do." [Sûrah al-Saff: 3]
Truth in word is the most familiar and obvious kind of truth, since every statement that is inconsistent with reality is obviously a lie.
Allah says: "Verily those who fabricate a lie against Allah will not find success."
Allah commands the believers, saying: "O you who believe, fear Allah and be among those who are honest."
Allah gives glad tidings to the believers who are honest. He says: "Allah will reward the honest people for their honesty."
Allah informs us that our honesty will bring us good even in this world: "And when a matter is resolved upon, it would be best for them if they were true to Allah."
And of course, honesty will be of doubtless benefit to us in the Hereafter.
Allah says: "This is the day that the honest people will benefit from their honesty।" [Sûrah al-Mâ'idah: 119]
Allah's Messenger (peace be upon him) was renowned for his honesty long before he began to receive revelation and became Allah's Messenger। He had been known among his people for years as al-Amîn (the Trustworthy) .
The Prophet (peace be upon him) informed us of the effects that both honesty and dishonesty have on our personalities when he said: "Honesty brings about security and lying fosters doubts।"
The Prophet (peace be upon him) also said: "Honesty leads to righteousness and righteousness leads to Paradise । A man remains honest and concerned about honesty until he is recorded as an honest man with Allah. Lying leads to sinfulness and sinfulness leads to the Fire. A man keeps lying and remains partial to lies until he is recorded as a liar with Allah." [Sahîh al-Bukharî and Sahîh Muslim]
He also explained the effects that honesty and dishonesty have on our interpersonal dealings: "Honesty and clarity are blessed for both parties to a sale, while concealment and deceit destroy the blessings of their sale।" [Sahîh al-Bukharî and Sahîh Muslim]
We must be honest in our relationship with Allah। There are many dimensions to this most important expression of honesty. There is our sincerity to Allah. Then there is being cognizant that Allah is ever watchful of what we do. There is the sense of humility and shame that we must feel before Him. If we truly want to be honest in our relationship with Allah, we must become so fully sincere to Him that there remains in our hearts no other motive for what we do but to seek His pleasure. We must care nothing for the thanks and appreciation of our fellow men. We can achieve this by making our greatest concern the attainment of Allah's mercy. We must be constantly aware that Allah is ever watchful over us. This will make us feel too shy to ever willingly disobey Allah.
Honesty with other people is also extremely important. There are many aspects to this as well.
First, we must be honest in our dispensation towards others। We should not behave deceptively and present a false face to people. Instead, we must be genuine and straightforward with people as much as possible.
We must be honest in what we say. This requires from us to be careful to ascertain the truth of the news that we hear before we go ahead and pass it on to others. The Prophet (peace be upon him) said: "It is enough to make a person a liar that he tells others everything that he hears."
We must be honest in giving advice to people। We should be sincere in our advice and truly do our best to help people avoid misfortune and attain what is good for them.
We need to be even more honest with our spouses. We must be able to confide in them and speak freely to them about our concerns, our secrets, and our ambitions. A husband or wife is a life partner, a friend, a confidant. The more openly a husband and wife are able to communicate with each other in an atmosphere of trust and confidence, the stronger their relationship will be.
Honesty, in fact, engenders strength on every level। On the personal level, it provides integrity, self worth, and inner fortitude. On the social level, it lends depth and substance to our relationships with other people. On the spiritual level, it brings about the sincerity to our Lord that is the key to our salvation.

Democracy. Why it is incompatible with Islam?
This article does not reflect my views but it is worth reading.
Democracy is a political system which cannot be even defined properly. The World believes its definition to be "Government of the people by the people for the sake of people."If someone wishes to look for definition of political system in an Islamic society then it is actually "Government of Allah over Allah's creation for the sake of Allah."
The difference is obvious, democracy despite all its benefit can never be an Islamic political system. Hence in an Islamic society the setup of a democratic political setup is not only impossible but also inappropriate.
Firstly Allah's presence is not due to human votes that if people vote then there is Allah if they don't vote then there is no Allah (Nauzubillah) .Allah is above the very temperament of democracy; whether people accept it or not he is Allah.Even if human beings created by Allah do not believe in Him this makes no difference whatsoever to His Sovereignty and Authority.Even if the creations of the Earth and the skies revolt against Him Allah still is the Creator,Malik- ul-Mulk (Creater of the Universe).
What right does this mortal creation(human) have to vote against the Presence and Sovereignty of the Eternal Creator?Who gave human this right?
Whether any human being wishes or not Allah is Allah, the Eternal, the Absolute, the Omnipotent, the OmniScient;Allah is above democracy. He is not accountable to any majority that is why he is Allah.Allah is Allah but even the Messengers of Allah are not decided by human votes and opinion of majority.Just like Allah is Allah, in the same way Prophet is a Prophet.Majority's opinion does not affect anyone's Prophethood.
This was about Prophets. Now let us come to the Last of the Prophets Muhammad (P.B.U.H), he is the Imam of all the Prophets and his status is not dependent upon people's votes.Whatever the Prophet(Peace be upon him) is not by opinion of humans but due to the staus given to him by Allah.
if a person holds qualities similar to Prophet Muhammad(P.B.U.H) and even if he has a majority of followers yet his status can never equal the status of Prophet(SAW) .At the most he can have the honor of being his Ummati.Prophets are not Prophets on the basis of people's opinions or on the basis of their qualities. They are Prophets due to Allah's decision, due to honor given by Allah: not due to what the majority of humans or angels say.Prophet Muhammad(P.B.U.H) is a Prophet due to Allah's choice; his status is not a status given by majority's votes but by the Supreme Creator, Allah(SWT).
Democracy has nothing to do with a Prophet being a Prophet. Now lets come to Islam.Islam is not by the opinion of the majority. It is from Allah; whether someone accepts it or not Islam is Islam. This Deen (Religion) is not by the opinion of majority but by Allah's order,Allah's will,Allah's blessing,Allah's decision.Democracy has nothing to do with it.Even if majority of world's population is non-Muslim then this does not mean that Islam is a wrong Deen or it has errors.Islam is the Deen of truth.Even if Islam's followers are in minority even then it is a true Deen;even if its followers perish away even then it is a true Deen.Democracy can play no role in the matter of this Deen.
All Deens before Islam have been wiped out by handing them over to democratic procedures. They were finished by opinion of majority and selfish leaders.Islam can never change neither by the order of a King nor by the opinion of majority of people.Islam has no space for any Martin Luther.People who suggested to turn this Deen into Deen-e-Ilahi (Allah's Religion) have been doomed forever.Neither any change can be made to this Deen nor any addition,it is the same like it was before. The majority has to submit to the Deen.Democracy and Islam can never be partners. If majority of the people are devoid of truth then who will vote for the system of truth "Islam"?In an untrue society whom will a true person approach for votes?
The democracy that was created in the name of Roti(Food),Kapra(Clothing) and Makaan(Shelter) we have seen its end and its outcome.Establishing democracy in the name of Islam is a severe joke with both Islam and Democracy.Islam is Islam and Democracy is Democracy.Democracy is government by majority and majority is away from Islam.
The important question to be asked is how can an Islamic society be created through democracy? Why would an Islamic society be created? What if majority makes the wrong decision then how can the result be in favor of Islam? If Yazeed and his supporters are in majority even then truth lies with Imam Hussain. This single thing was not understood by Yazeed's followers that Hussain is alone and true.Yazeedis are in majority and are false. Its their government and they are false.
The reason for going through the Karabala of truth and Imamat is that majority holders forgot due to opinion of majority that Islam is not a matter of majority's opinion. Its about love and following of Muhammad's teachings. The love of Allah lies in obedience to the Prophet and Prophet's love lies in obedience to Allah. If vote is made a necessity then the difference between truth and falsehood will be eliminated,a Qadiani's vote would become equivalent to the vote of a Mufti-e-Islam, it would be nothing but destruction, a false vote equal to a true vote.
The main reason for Islam not being implemented upto now is that people were continuously asked for opinion and votes. What other reason can there be for not having Islam implemented over the Muslims? What other reason can there be not having Islam implemented over the creation and believers of Allah?Somehting, somewhere there is a big mistake. Will democracy eliminate this mistake after discovering it?No never!!!Democracy will implement itself, not Islam and what will be the outcome? That is not difficult to understand.
Democracy's journey is a journey of rallies and speeches,a journey of speaking truth mixed with falsehood,a journey of opposition of the former government,a journey of compromises and differences. Like peace is the name of the interval between two wars, likewise democracy can be the name of the interval between Martial Law and Martial Law.Democracy is not able to distinguish truth from falsehood, democracy depends upon quantity not quality.
Democracy gives poison to Socrates, hangs Mansoor, does no respect Isa.Through democracy any scholar,Imam, thinker,Alim- e-Deen or Wali can never come to power and people who come to power through the expensive ways of democracy what do they have to do with the implementation of Islam!!!!Uptil the time we do not have majority of truth-seeking, truth-speaking and truthful people, democracy is a dangerous game!!!!
